LICENSE POLICY BASICS —>
CJADE Designer Studio (“Licensor”) grants the purchaser (“Licensee”) a limited, non-exclusive, non-transferable, non-sublicensable license to use the licensed artwork solely for the purposes and within the limitations described in this Agreement and the applicable license purchased.
This Agreement grants rights of use only. It does not sell, assign, or transfer ownership of the artwork or copyright.
All copyrights and intellectual property rights in the artwork remain the exclusive property of CJADE Designer Studio.
LICENSED ARTWORK
This license applies only to the specific artwork(s) identified in the purchaser’s order, invoice, license certificate, or digital download.
A license for one artwork does not automatically grant rights to use any other artwork created or owned by CJADE Designer Studio.
SVG & PHYSICAL PRODUCTION LICENSE
When an artwork is purchased with an SVG / Production License, Licensee may use the licensed artwork to manufacture and sell finished physical products.
Permitted applications may include:
- Apparel
- Accessories
- Home goods
- Stationery
- Packaging
- Promotional merchandise
- Décor
- Printed goods
- Craft products
- Manufactured goods
- Other physical products incorporating the artwork
The license permits production of up to 500 finished physical units per licensed artwork.
The 500-unit limit applies separately to each licensed artwork.
Once 500 finished physical units have been produced, additional production requires an Extended Production License from CJADE Designer Studio.
The Licensee may not use the artwork to create or sell the digital artwork itself as a standalone product.
ANIMATED MEDIA LICENSE
When an artwork is purchased with an Animated Media License, Licensee may incorporate the licensed animation into:
- Social media posts and content
- Social media advertisements
- Websites and landing pages
- Digital advertising
- Digital presentations
- Promotional videos
- Online portfolios
- Email marketing
- Digital campaigns
- Other comparable digital promotional media
The licensed animation may be displayed publicly as part of finished digital content.
The Licensee may resize, crop, or make reasonable technical adjustments necessary for digital publication.
The Licensee may not redistribute, sell, sublicense, upload, or otherwise provide the original animation file or an extractable version of the artwork to another party.
The artwork may not be offered as a downloadable asset, stock asset, template, design resource, or standalone digital product.
DIGITAL FILE RESTRICTIONS
Under no license may the Licensee:
- Resell the original digital file
- Redistribute the digital file
- Share the digital file with customers or third parties
- Upload the file to stock-art websites
- Upload the file to digital marketplaces for redistribution
- Make the file available as a downloadable resource
- Sell the artwork as an SVG, PNG, JPEG, AI, EPS, PDF, or other digital asset unless specifically authorized in writing
- Create templates or design resources intended for redistribution using the artwork
- Sublicense the artwork to another person or company
- Claim ownership of the original artwork
The Licensee may provide the artwork to a manufacturer, printer, production facility, or other necessary service provider solely for the purpose of fulfilling an authorized licensed production, provided that the third party does not receive ownership or independent rights to the artwork.
SOCIAL MEDIA & PORTFOLIO USE
Licensee may display authorized finished products containing the artwork on:
- TikTok
- Websites
- Online shops
- Digital portfolios
- Other comparable promotional platforms
Such display does not grant permission to upload or distribute the original artwork file.
EXCLUSIVITY
Unless an artwork is expressly sold under a separate Exclusive License Agreement, all licenses granted by CJADE Designer Studio are non-exclusive.
CJADE Designer Studio retains the right to license, sell, display, reproduce, and otherwise use the artwork and to grant licenses to other parties.
An exclusive license must be separately negotiated and executed in writing.
TERM
Unless otherwise stated in writing, the license remains valid for the duration specified on the applicable product listing, invoice, or license certificate.
A license may be terminated if the Licensee materially violates this Agreement.
Upon termination, Licensee must cease all new use and production of the licensed artwork and must not continue manufacturing products under the terminated license.
Previously manufactured products may be subject to separate sell-through rights if expressly provided by CJADE Designer Studio.
EXTENDED PRODUCTION
Production exceeding 500 finished physical units per artwork requires an Extended Production License.
Extended licenses may be available for:
- Manufacturing runs exceeding 500 units
- Large-scale retail production
- Mass manufacturing
- Print-on-demand operations
- Wholesale production
- Licensing to multiple brands or businesses
- Broader commercial applications
Extended licensing terms and fees are determined separately based on the intended use, quantity, territory, duration, and scope of the project.
COPYRIGHT & OWNERSHIP
CJADE Designer Studio retains all right, title, and interest in and to the artwork and all associated intellectual property rights.
No provision of this Agreement constitutes a sale, assignment, or transfer of copyright.
The Licensee receives only the specific rights expressly granted under the applicable license.
Licensee may provide the necessary production file to a printer, manufacturer, fabricator, or other service provider solely for authorized production.
Licensee is responsible for ensuring that such third parties do not retain, redistribute, sell, sublicense, or otherwise exploit the artwork.
LICENSE VIOLATIONS
Unauthorized reproduction, distribution, resale, sublicensing, or use beyond the scope of the purchased license constitutes a violation of this Agreement and may result in termination of the license and other remedies available under applicable law.
Purchasing a digital artwork file, SVG, animation, or license does not give the purchaser ownership of the underlying artwork.
The artwork remains the intellectual property of CJADE Designer Studio.
By purchasing, downloading, accessing, or using licensed artwork from CJADE Designer Studio, Licensee acknowledges that they have read, understood, and agreed to the terms of this Agreement.
